As most of you know, last week several community sites in the lefty blogosphere played host to Operation Yellow Feather. It all started with an idea from BostonJoe and quickly took off through the help of several bloggers.
I have to admit that the results took me by surprise. For three days I had numerous tabs open in my Firefox browser, trying to manage the various posts that I wrote at different sites.
The protest proved to me that we can work together across the blogosphere for a common purpose. I hope that we can apply a similar approach to the upcoming SCOTUS nomination, resulting in the defeat of nomination of Samuel Alito
My thoughts below the fold, as well as a call to action…
Here are the things that worked well with Operation Yellow Feather (OYF), that I think could be useful for the scAlito defeat:
- Brainstorming diaries work, we already have one for the Twelve Days of Alito (i’m partial to The Twelve Days of Justice, but that’s just me)
- follow-up diaries are necessary to build anticipation and give clarity to the upcoming campaign. See BostonJoe’s OYF examples here and here
- the Master diary should be clear on the campaign’s purpose and be a home-base for all the action items. Here was the initial OYF diary
- Coordination is necessary to make sure the DailyKos gets involved. The site has the numbers and exposure necessary to make sure it spreads across to different sites. It is helpful to know when the DKos diary will be posted, and who the author will be (preferably the same as here, but not necessary IMHO)
- Ops Center diaries worked for OYF as a way to organize the actual campaign. Here’s an example. It provides a forum for feedback on the campaign logistics, which is different than actually discussing the meat of the protest (in our case, Alito’s views on this, that and the other thing).
- Give your participants direct Thank-Yous for their participation. It helps to empower them to continue their assistance, attract new recruits, and genuinely praise their involvement. We’re all busy people so any time spent is precious.
- Over-hype the cross-blog participation. Make sure there is a listing of all the blogs participating, as well as links to the diaries. This raises everyone’s sitemeter hits and makes for happier hosts. It also helps ease some of the cross-blog sniping that does nothing productive for the progressive community. These types of projects are about collaboration and common ground.

As Cheney might say, ‘migraines suck big time’…glad to hear yours has subsided. I get migraines and if not for my prescription to help keep them under control I’d be goner I think. I do hope you have medication to help you with them Manny. Anyone whose had a migraine knows how seriously dehabilitating they can be…and bear no resemblance to a ‘normal’ headache at all.
Great diary also and will try and help all I can..Alito just gets scarier and scarier-not that that’s much of a surprise really.

“mojo-fest” in our DKos threads contributed to the fact that there were zero flame wars. The discussion remained civil over three days, I left it feeling very positive.
I was pleasantly surprised at the response the Yellow Feather campaign recieved as well. I just sat there in disbelief lol.

I was feeling so frizzled and frazzled the past two days with just…life. Gathering info on Alito and thinking how to do this was beginning to feel like some horrible end of semester term paper in a course I forgot to attend!!

Thanks for all your research so far on this, I hope to be more present to the coordination in the coming days. We’ve got alot of organizing to do, but with more hands helping, it will be less overwhelming for all, and more powerful in message.
So ummmm…. Will there be any coat hangars involved in this campaign?
They are to “anti-choice” people what yellow feathers are to chickenhawks… In a back-alley abortion kinda way. That is precisely what we have to look forward to if scalito gets appointed since he will overturns Roe vs Wade given the opportunity.
BTW… I registered at Dembloggers so it can be cross-posted and recommended without searching out someone with an account this time.
Has anyone else done that yet? Being that I am an independent and very voiciferous about that across the net, I am pretty sure that I am not posting squat there. But I will recommend and comment! lol
It is critical to have all of the ducks in a row before hand.
It gets posted and … BOOM … We know where and when to go, recommend, and comment. There should be no question about where and when something will be posted.
I also think that you should be blatant about this being from the same group of Boo Tribers that brought them Operation Yellow Feather.
It does 2 things.

Also, considering the juggling you and others were doing on keeping each of those posts active with actual responses to the comments, maybe it would be easier if each diary were posted in half hour intervals allowing for some time for interaction at each diary?

Ideally, we would contact some of the regulars at the blogs to alert them of what’s going on (and they host a diary on their own).

I’m hoping for more bloggers to sign on for the 12 day protest, that way the work is spread out more. The contant interaction is hugely important, this shouldn’t be a post and run job at the various sites. That’s why I think OYF was successful, we were engaged in each of our threads.

I watched something a couple of days ago about wanting to take a picture of a large group of naked people at a concert. It was one of the Lollapalooza type big event deals. They were worried about security because they thought they might get as many as 60-70 people. Sheeeeit! They opened the gates and got 1200 naked motherf……!!
A perfect example of how to grow the coalition and by the grace of the FSM unite the blogosphere in opposition to scAlito’s nomination. If we send a strong message together to our congresscritters, both Dems and Repugs, then perhaps they will start to listen to our concerns.

Like the hangers… they’ll necessarily have to be paper (or something) to actually reach the Senators, so one idea could be to make up a page that can be printed out … or many pages. hmmm. Anyway, hangers on a page that, when cut across the dotted lines, fit right into a standard size envelope, and inside of each hanger a story of a woman before roe v wade. Just a short synopsis, of course… I’m sure planned parenthood and others have many of them, or maybe people here and other places would share theirs.
So that each hanger has a different story in the little triangle part, and people can send different ones to different senators.
If I am not making much sense, I’ll retype this in the morning ;).
plus it’s not too easy sending real coat hangers through the fax machine. The message we send each day has to resonate enough to screw with their consciences.
I am heading to bed now, I have to work in 7 hours, lol.

We both remember the days before Roe. I remember knitting needles, and motel rooms full of blood.
Do you have the days written yet? I think just a printed coathanger with an accompanying story would be fine – no need to try to send any object for this action. A refined and organized approach should be effective. I’m going to work on writing the days now, will watch for you.

Things have kind of blown up for me in personal life this week. Book, book, book. I’m afraid it is necessarily going to eat into my bloggin/activist time. I still want to be involved with “Alito” fight though. And will do whatever I can. I’d appreciate anyone dropping me an e-mail on action items if I’m not obviously present in an online way. Even the image of a coat hanger (which WILL fit through a fax machine) is strong. Or a baseball bat….
One of the most powerful stories I read a while back was from someone (moiv?) about how desperate teenaged girl got her boyfriend to hit her in the abdomen with a baseball bat every day in hopes of causing her to abort “naturally”… it was utterly horrifying. And moiv’s diary on The Last Abortion Clinic: Whistling Past the Graveyard that discusses women who are even now suffering and dying due to lack of access to legal and safe abortion.
Stories are powerful things, too. Personal stories, stories of real people affected by the lack of access to abortion, women and their families. In fact, those stories may be more powerful without the image of something like a coathanger… because if someone sees the coathanger first, they may just toss any message without reading it. Get them reading it first… then the message gets through.
And the message is simple: Safe, Legal Access to Abortion Saves Women’s Lives and confirming Alito will put women’s lives at risk.
And that the nations where abortion is illegal have the highest abortion rates in the world, plus a high rate of women dying from botched abortions, where those nations who have safe and easy (often free) access to abortion and contraception have the lowest abortion rates.
I hope we can count on you to help tailor the response that day when we focus specifically on Alito’s abortion views. I also think it’s important to call out their bullshit that Bush doesn’t want judges who “legislate from the bench”, because this is blatant hypocrisy wrt Roe v. Wade. The fact is: it is currently law and judges like Alito want it overturned.

What do you want to see in a campaign to stop Alito?
I had an idea early this morning when I was still foggy. As I was reading some of the info in the Alito quick facts I linked to in one of my comments above I thought about making direct contacts with groups that would be directly affected by his rulings were he to be confirmed like unions or workers rights groups who might have some small media pull, or the disabled. This (my thoughts) really isn’t going anywhere yet and maybe I’m thinking too big but I’ve felt like we need to reach wide and far. For example reaching out to John Conyers. I know he’s frustrated with the Senate and the process, and he’s been willing in the past to tap the energy of the blogosphere.
I’m headed back to work to kick these things around a little more. Hopefully I’ll have narrowed my thoughts about these things a little more by the time I get back I get back.
Whatever I’ve got I’ll post.

OK, how about this. Alito was a member of a group that wanted to kick women out of Yale, right? Who are some well known and well liked women who graduated from Yale after that? Maybe a picture of some of them with a little bio and “Alito wanted to keep her out.”

Take this outside the blogosphere.
What I originally meant by that is: I get email letters all the time from various lefty/Dem groups. MoveOn comes immediately to mind; I’m sure there are others, most notably women’s rights mailing lists, that have pretty wide memberships. We get them involved in the idea. I absolutely freakin’ HATE getting ATM withdrawal slips from groups whose only interest is to have me send them money to help defeat $SOME_SCARY_CAUSE, but I’m a sucker for “click here to sign the petition” and the like.
So, we enlist groups who have or should have a similar reason along with our own to defeat Alito, and suggest things their members can do to help defeat him.
But then I got to thinking, there is leafleting and neighborhood activism and the like that could be done on a local level as well. This is not my strong suit, but I bet you can find others who are pretty good at coming up with ways that you could get your average soccer mom to come out swinging against Alito.
Anyway, those are my ideas. The big thing is, all this has to be seen by Congress as part of a concerted effort by their real employers — us, not the moneyed interests in this country and certainly not the American Taliban — to get them to realize that we do not want Alito on the bench of the Supreme Court.

As long as we’re convening the Mutual Admiration Society, let me just say that every time I see your name attached to a post I think of the Rocky Horror Picture Show. Don’t know if that’s why you chose it, but that’s what it reminds me of.
Blogs are one thing and they do get the word out… but.. I think two HUGE assets would be the moveon.org mailing list as well as maybe the DFA/DNC type mailing lists. Maybe not just their lists but it would be awesome if moveon.org got the word out or got onboard with the Yellow Feather. Or something along those lines.
Also… I get Sierra Club Alerts – I’m sure that if some of the campaign/feather alerts deal with the chickenhawks being a polluter or Corporate Whore… we should get them involved so they could pass out the alerts/campaign.
Alito… I’m sure N.O.W. might want to be involved with tar and feathering his ass(?) But I’m not too aware of NOW and their politics… but my point is we have to take these action alerts/feathers and get everyone onboard. A great idea is to be shared. Great ideas spread quickly and I’m not sure we should just keep it in the blogosphere. Take it to the main advocacy groups like MoveOn and next thing you know… it’s hitting the streets.
We need to light a fire under the asses of not just the Republicans but also all the other groups.

I really like this idea – focusing on whatever egregiousness we highlight for that day. Abortion, worker’s rights, corruption/conflict of interest, etc. Having a variety of relevant stories to tell that makes the issues personal.
I saw the most re-thinking among R’s (hmmm . . . was it really such a good idea to vote for this guy?) during the Terri Schiavo outrage – precisely because it was so personal. Almost everyone has had a family member that someone had to make a difficult decision about at the end of their life – or dreads the day when they will have to for someone they love. The thought of such a personal and sad time being made a media circus for political gain was horrifying to a lot of people, not just those of us on the left.
And it occurs to me that whatever we send will be seen mostly by staffers in the Senators offices. They (we hope!) will pass onto to the Senator that they are receiving a lot of faxes, emails, letters about —- and maybe some samples, but getting the message across to the staffers themselves might result in discussion in the office that finds its way to the Senator, and reinforces the message.
For abortion rights especially, many of these staffers, interns, etc. may be very young and have no idea what is at stake since they have always taken the right to a safe abortion for granted (thinking of my 25yo daughter).

I like the personal stories angle too. And also the idea of getting different issue groups involved and aware, not just doing the senate/house thing. I’m not going to have as much time on this as I thought, but I’m still very in. I’m just not an ideas person, per se…
Ok, so it’s a given that we’ll be contacting Sens. and Reps. by fax, mail, email, phone, etc. I see lots of us thinking that reaching out to targeted groups that will/could be affected by Alito’s positions and trying to enlist them in the effort should be part of it too. I’ve been searching for groups that plan real protests but no luck yet. I’m a little, well a lot surprised by this. Maybe more worms on the hook will catch more fish so….bait your hooks! I like Omir’s real action ideas. Can we get some small local media coverage of actions like this which can then be sent along to Congress, etc.?
Maybe for tonight and tomorrow we can concentrate on locating some of these planned protests (their out there somewhere) and linking them back here. Also finding the future victims of scAlito, disabled, workers, and so on and linking to those groups too. Then perhaps some of us can concentrate on the reaching out part, and some others can begin working on the smaller, initial protests such as faxing pictures of hangers and so on.

Yes – and doing something when the hearings begin seems too late. However, contacting groups that will be affected or have been affected by Alito’s decisions as part of our “12 Days for Justice” might increase and diversify the protest level and during the hearings.
BTW, I contacted Specter’s office again on Fri., Dec. 2nd. The hearings will begin on Monday, January 9th. I was told the “7th” was a typo.
The hearings will be in the Senate building, room TBA; the public is “invited,” but on a first come basis.
Just printed up the 24 page PDF from People for the American Way – will be wading through it today, highlighter and dictionary handy!
I guess we can do research individually today….everyone???? hint hint ;o)

I’m going to probably be a bit repetitious here (and also reference other people’s ideas, without attribution) because it’s easier to keep the flow going:
I think bring other established groups in would be a great idea. Am not really sure how to do that, but one thing I’ve found is that experts love to be asked about their area of expertise. So, in the planning for the worker’s rights part of things, we could email people involved in the labor movement (including ones like Nathan Newman, at TPM), exlain the project and ask them what images/symbols/sayings would have the most resonance among their groups. Even if we know (I don’t, I’m afraid) we ask anyway, as a way of generating curiousity and also of bringing them (possibly) into the project.
Same for disability rights, women’s reproductive rights and so on. On the last, by the way, someone (John of America Blog?) pointed out that a good many gay rights have been won on the basis of Griswold and Roe v Wade and so on, so if that underpinning goes, it affects not only women, but gays. That might be something to point work with there, as well.
Oh well, my brain stopped working. But anyway, how are we setting this up? (this is probably already somewhere, but I don’t know where). Is there an organizational site/diary? Or we’ve not gotten that far yet?

You know, and I am not denigrating you graphic efforts here at all, CM1, I hope you know that. But I have always thought that a picture of say, someone like me, with her two sons, with the caption “I had a choice”, and/or another kind of situation, such as the one boran2 described, image and “we had a choice”, or Militarytracy and her beautiful Joshman, “we had a choice” and this goes for every damned civil rights issue that is threatened — make people equate choice with civil rightsn — do ya’ll see where I’m going with this?
Whatever hits home most, then give them that image.

This is the direction I would go since it really shows what it is all about. But it is a little overly graphic even for me.
This will involve more than just “Women’s issues” since it is about many different aspects of Alito. He has ruled against people with disabilities, ruled in favor of corporate interests, etc. .

When I talk about multi-faceted, I am not refering to JUST the abortion issue. I have a disability and it has absolutely nothing to do with abortions. He has ruled agains people with disabilities.
This won’t be just “12 days of womens issues” ya know? lol 🙂
There is the disability issues, constitutional issues, corporate issues, etc.. Don’t lock yourself in on this one abortion issue, and there can and should be many ways to protest each of the issues. Just like there was in OYF.

I mean, is Moveon.org a cyber circle jerk because the bulk of what they do, besides raising money, is petition signing drives? Personally, I don’t think so. Reaction to the nomination
In general, initial reaction to Alito’s nomination was strongly positive from conservative and Republican Party commentators, and generally negative from liberals and Democratic Party members.
Many Democrats have voiced opposition to his nomination to the Supreme Court. Senate Minority Leader Harry Reid (D-NV), who had publicly supported Miers’ nomination, made a statement saying, “Conservative activists forced [Harriet] Miers to withdraw from consideration for this same Supreme Court seat because she was not radical enough for them. Now the Senate needs to find out if the man replacing Miers is too radical for the American people.” [17] Reid also stated that Alito’s nomination “would create a lot of problems.” [18] Ted Kennedy (D-MA) said that Alito’s nomination is “based on weakness, not strength.” [19] Senator John Kerry (D-MA) released a statement saying that, “Every American should be deeply concerned that the far right wing which prevented Harriet Miers from even receiving a Senate hearing is celebrating Judge Alito’s nomination and urging the Senate to rubber stamp the swing vote on our rights and liberties.” [20] Ralph Neas, president of the People For the American Way, said that “President Bush put the demands of his far-right political base above Americans’ constitutional rights and legal protections.” Senator Ben Nelson (D-NE) disagreed with other Democrats on Alito’s nomination, saying that Alito would not “hammer away and chisel away” exisiting law. [21]
Supporters of the president counter Democratic opposition by arguing that the “far right wing” is a key segment of American society that deserves an equal voice and equal representation. They point out that President Bush promised those who would vote for him that he would appoint a justice to the Supreme Court that would be a so-called strict constructionist, and now he is fulfillling his campaign promise.
Alito was confirmed unanimously to the 3rd U.S. Circuit Court of Appeals in Philadelphia in 1990. Some Democrats, such as Senator Kennedy, who praised Alito during that confirmation process now oppose his nomination to the Supreme Court, saying 15 years of judicial rulings and opinions have changed their view.
NARAL Pro-Choice America, a women’s rights group, said that the nomination of Alito would threaten “fundamental freedoms, including a woman’s right to choose.” The National Pro-Life Action Center, which “supports the sanctity of human life from conception to natural death”, said that Alito’s “It appears that President Bush has heeded the call of pro-life Americans and nominated Judge Samuel Alito, Jr. to the United States Supreme Court.”[22]
Reaction from Republicans has been more positive than the response to Miers’ nomination. Senator Orrin Hatch (R-UT) commented that, “President Bush has hit a home run by selecting Sam Alito.” [23] Senator Sam Brownback (R-KS) also voiced his support: “I commend the president and congratulate Judge Alito on this nomination.” [24]
Likewise, reaction from usually Republican aligned interest groups has largely been positive, with Progress for America already launching a televised ad lauding his nomination. [25] The group commented: “No one can argue that Judge Alito is anything but extremely well qualified for the Court and his unanimous confirmation to the Third Circuit Court of Appeals will undermine any attempt by liberals to argue that he is a ideologue.” [26]
Some politicans have called for both sides to wait until Senate hearings begin before supporting or opposing Alito’s nomination. Senator Dianne Feinstein (D-CA), who voted against Roberts when he was nominated for Chief Justice, said, “I would hope that people on both sides would hold their fire, allow the Judiciary Committee to do its work, and not take a position until that work is completed.” [27]

Abortion
* Samuel Alito supported limited abortion rights in 3 out of 4 rulings as described below. [28]
* A dissenting opinion in Planned Parenthood v. Casey, 947 F.2d 682 (3d Cir. 1991), arguing that a Pennsylvania law that required women seeking abortions to inform their husbands should have been upheld. Judge Alito wrote:
“[t]he Pennsylvania legislature could have rationally believed that some married women are initially inclined to obtain an abortion without their husbands’ knowledge because of perceived problems — such as economic constraints, future plans, or the husbands’ previously expressed opposition — that may be obviated by discussion prior to the abortion.” He added some exceptions: “These exceptions apply if a woman certifies that she has not notified her husband because she believes [FN4] that (1) he is not the father of the child, (2) he cannot be found after diligent effort, (3) the pregnancy is the result of a spousal sexual assault that has been reported to the authorities, or (4) she has reason to believe that notification is likely to result in the infliction of bodily injury upon her.”
The Supreme Court ruled against Alito’s position in a plurality decision, in which five justices ruled that a parental notification requirement violated the woman’s rights. Rehnquist’s dissent quoted Judge Alito and expressed support for his reasoning.
* A majority opinion in Planned Parenthood of Central New Jersey v. Farmer, 220 F.3d 127 (3rd Cir. 2000), [29] in which Judge Alito recognized that a New Jersey law banning intact dilation and extraction (commonly called “partial-birth abortion”) was unconstititional in light of the then recent Supreme Court case of Stenberg v. Carhart, 530 U.S. 914, 120 S.Ct. 2597, 147 L.Ed.2d 743 (2000), which struck down a nearly identical law in Nebraska.
* In 1995, voted to strike down an abortion restriction in a Pennsylvania law that required women seeking to use Medicaid funds to abort a pregnancy resulting from rape or incest to report the incident to law enforcement officials and identify the offender.
* Ruled the Constitution does not afford protection to the unborn in a 1997 challenge to a New Jersey law that prevents parents from suing for damages on behalf of the wrongful death of a fetus.

First Amendment
* A majority opinion in Saxe v. State College Area School District, 240 F.3d 200 (3d Cir. 2001) [30], holding that the public school district’s anti-harassment policy, which prohibited harassment based on sexual orientation among other criteria, was unconstitutionally overbroad and therefore violated First Amendment guarantees of free speech. Alito wrote: No court or legislature has ever suggested that unwelcome speech directed at another’s ‘values’ may be prohibited under the rubric of anti-discrimination.
* A dissenting opinion in Banks v. Beard, 399 F.3d 134 (3d Cir. 2005), arguing that the prison policy prohibiting inmates of a segregated unit from accessing news media or family photographs was not a violation of the First Amendment. Alito reasoned:[31]
[T]here is a “rational” relationship between that restriction and the legitimate penological objective of deterring misconduct. It is “rational” for corrections officials to think that inmates who are not in Level 2 will be deterred from engaging in serious misconduct because they do not want to be transferred to that unit and thus to be subjected to the restrictions that accompany that assignment. It is also “rational” for corrections officials to think that inmates who are in Level 2 will be deterred from engaging in serious misconduct while in that unit because they wish to be transferred out and thus to escape such restrictions.
* A majority opinion in Child Evangelism Fellowship of N.J., Inc. v. Stafford Twp. Sch. Dist., 386 F.3d 514 (3d Cir. 2004) involving the Establishment Clause. The court found that a school district could not preclude an evangelical group from distributing its newsletters where the school district permitted other private groups to do the same.
* A majority opinion in Blackhawk v. Pennsylvania, 381 F.3d 202 (3d Cir. 2004), involving the Free Exercise Clause. The case involved a Native American’s ritual that used black bears. The state denied the plaintiff an exemption to a $200/year exotic wildlife dealer permit to keep the bears under the state’s Game and Wildlife Code. The court found that the code invoked strict scrutiny. The majority found the code was “substantially” under-inclusive and did not satisfy strict scrutiny.
* A majority opinion [32] in ACLU v. Schundler, 168 F.3d 92 (3d Cir. 1999), addressing the circumstances under which a government-sponsored holiday display may or may not contain religious symbols. The case held that a holiday display consisting solely of religious symbols was impermissible, but a mixed display including both secular and religious symbols was permissible if balanced in a generally secular context. The decision relied on a previous Supreme Court decision that had permitted such mixed displays. The ACLU had argued that a previous city display that was ruled unconstitutional because it lacked secular symbols colored the purpose of the new display.
* A dissenting opinion in C.H. v. Oliva et al. (3rd Cir., 2000)[33] arguing that the removal and subsequent replacement in “a less conspicuous spot” of a kindergartener’s religious themed poster was, at least potentially, a violation of his right to Free Expression
* A unanimous opinion in Police v. City of Newark, 1999; [34] allowing Muslim police officers in Newark to keep their beards because “the Department makes exemptions from its policy for secular reasons and has not offered any substantial justification for refusing to provide similar treatment for officers who are required to wear beards for religious reasons.”
* A unanimous opinion in The Pitt News v. Pappert, 2004, [35] upholding the right of student newspapers to carry alcohol advertisements on First Amendment grounds. “If government were free to suppress disfavored speech by preventing potential speakers from being paid, there would not be much left of the First Amendment. “

Harassment and discrimination
* A majority opinion in Williams v. Price, 343 F.3d 223 (3d Cir. 2003), [36] granting a writ of habeas corpus to a black state prisoner after state courts had refused to consider the testimony of a witness who stated that a juror had uttered derogatory remarks about blacks during an encounter in the courthouse after the conclusion of the trial.
* A dissenting opinion in Sheridan v. Dupont, 74 F.3d 1439 (3d Cir. 1996)(en banc). [37]. Alito would have required a plaintiff to meet a higher standard of evidence to survive a motion for summary judgment in a sex discrimination case, agreeing with a ruling by the 5th Circuit. Alito earlier wrote the majority opinion when the case was heard before a three-judge panel, [38] expressing a preference for the 5th Circuit’s reasoning, but ruling according to 3rd Circuit precedent.
* A dissenting opinion in Bray v. Marriott Hotels, 110 F.3d 986 (3d Cir. 1997), [39] arguing that, when a Marriott housekeeping manager sued Marriott over being allegedly denied promotion on the basis of race, summary judgment in favor of the defendant was appropriate because the plaintiff had not presented enough evidence to allow a reasonable jury to conclude that every one of the reasons Mariott offered for having promoted someone else was a mere pretext. The majority responded that finding in favor of Marriott would have protected racist employers by “immuniz[ing] an employer from the reach of Title VII if the employer’s belief that it had selected the `best’ candidate was the result of conscious racial bias.”

Other case decisions
* A majority opinion in Fatin v. INS, 12 F.3d 1233 (3d Cir. 1993), rejecting an Iranian woman’s petition for review of a deportation ruling and denying her asylum in the U.S. in spite of her gender and feminist ideas and the human rights issues in her home country. The opinion did establish, however, that women in slightly different situations might be able to establish an asylum claim if they would absolutely refuse to wear Islamic dress and would face death as a result.
* A majority opinion in Shore Regional High School Board of Education v. P.S., 381 F.3d 194 (3d Cir. 2004) [40], reinstating an administrative law judge’s ruling in favor of parents who claimed the school system’s failure to protect their child from bullying justified their placing him in a different high school.
* A dissenting opinion in Homar v. Gilbert, 89 F.3d 1009 (3d Cir. 1996), arguing that a state university need not hold a hearing before suspending a campus policeman without pay after he had been arrested on drug charges. The Supreme Court later agreed with Alito.
* A majority opinion in Southco, Inc. v. Kanebridge Corp., 390 F.3d 276 (3d Cir. 2004), [41] a copyright case discussing the issue of originality. Alito held that “the creative spark… utterly lacking in [a part’s numbering system, and thus] these numbers are examples of works that fall short of the minimal level of creativity required for copyright protection.”
* A majority opinion in United States v. Lee, 359 F.3d 194 (3rd Cir. 2004). Alito rejected a defendant’s argument that his Fourth Amendment rights were violated by the introduction into evidence of a videotape recording of a meeting with an informant who consented to the videotaping.
* In a dissent to Doe v. Groody, Alito argued that qualified immunity should have protected police officers from a finding of having violated constitutional rights when they strip-searched a mother and her ten-year-old daughter while carrying out a search warrant that authorized the search of a residence. The mother and daughter were not referred to in the warrant, although the affidavit with the warrant requested permission to “search all occupants of the residence and their belongings”. The court’s opinion found that the warrant did not grant such permission, arguing that references to the affidavit in the Warrant were specific and the omission of the language in question from the warrant was not found to be the result of an error, clerical or otherwise.[42]

Conflict of interest question
On a questionnaire for the Senate Judiciary Committee in his court-of-appeals confirmation process in 1990, Alito said he would avoid a conflict of interest by not voting on cases involving First Federal Savings & Loan of Rochester, NY, and two investment firms, Smith Barney and Vanguard Group, because he held accounts with them. However, in 2002, Alito upheld a lower court’s dismissal of a lawsuit filed against multiple investment company defendants, including Vanguard Group. When notified of the situation, Alito denied doing anything improper but recused himself from further involvement in the case .
On November 10, Judge Alito wrote Senator Specter, the chairman of the Senate Judiciary Committee, explaining his participation in the case [43]. He said that when he had originally listed Vanguard and Smith Barney in 1990, “my intention was to state that I would never knowingly hear a case where a conflict of interest existed. […] As my service continued, I realized that I had been unduly restrictive.”
I’ve found a lot of “opinion” out there about Alito, but next to nothing when it comes to physical opposition short of petitions and requests for money. It’s pretty frustrating actually. It makes me wonder if there’s real opposition or not. I have not found ONE planned physical protest listed out there…..yet ;o)
Whatever we end up doing, it needs to be stark and have shock value. Sensibilities need to be shaken.
