I would feel really good too if I thought there was a snowball’s chance in hell that this judges ruling concerning provisions of the Patriot Act will ever be followed or supported up the judicial chain.
This administration sees these types of rulings as nothing more than small speed bumps on their road to greater executive authority. In their view the judiciary is only there for one thing and that is to sanction their views on executive power. While Mayfield won, the principles surrounding the Patriot Act and its infringement on Fourth Amendment rights will most certainly go on unfettered. Virtual guarantee that portion of the ruling will be overridden and/or ignored. It will never see the light of day.
