I think y’all can have a fruitful discussion of Richard Posner’s comments about the ‘goofy’ modern Republican Party while I navigate my way back to the Keystone state. He echoes what I recently had to say about blasting Chief Justice John Roberts.

The Tea-haddists were trying to drag Roberts, a corporatist, over to their version of crazy. I’m an attorney. My daughter is in law school. Months ago, I predicted the Court would sell out the TPers so as to not squander their credibility, which they’re saving up to dissipate in decisions like Citizen’s United and Bush v. Gore. Roberts is all about selling out to wealth and power.
What surprised me about the ACA ruling was not Roberts’ giving the finger to the Tea Party; it’s that four justices were ready to sacrifice the Court’s reputation (what’s left of it) on the alter of rabidly right-wing activist politics. Particularly Kennedy. Alito to a lesser extent.
Of course nothing that Fat Tony and Uncle Tom write or say or think ever surprises me. My guess was 7-2. Like everyone else, I was surprised it all came down to Roberts, the lone voice for sanity from the right flank of the Court.
It’s possible that Kennedy honestly thought the law unconstitutional. I don’t know. I haven’t read Kennedy’s dissent.
I have read Robert’s opinion. It makes no sense. No wonder CNN reported that he was ruling that the law was unconstitutional. The whole opinion supported that until the last one or two sentences.
Does Kennedy’s dissent make sense? I’m not asking if you agree with it. I’m asking if it was logically consistent.
Sometimes split decisions make sense depending on the premises and viewpoints.
nowadays, I rarely post as comment. I just love reading everyones opinion. However, I want to interject something here as how I see it.
The ACA is basically a foundation on which we can build. It is neither perfect in and of itself. I think, if I have read it correctly and what the President is saying, we (congress) now have the duty to improve upon it. Sure every one has an opinin like every one has an anus, as the old saying goes; therefore and consequently, I personally feel it is just that. I am an INdependent and I lean to the Democrat’s side in most cases, but I do not give much into what is being said by Posner. After, rememb er he is expresing what most moderates of the Republican party is thinking also.
Yes. the whole idea that the crazies are out to tear down our democracy is true…theyfind anything they can to discredit out President. I am very scared but still have true feeling in my bones that the President will win a second term to start the ball a rolling. After all his agenda must take more that one term and the gop knows it, that’s why they are tryingto make him a one term president. NEVER FORGET THAT…THEY STARTED on DAY ONE TO DO THIS!!!!!
I have a lot more to say about things but that will do for today…..hugs and so good to see ya ll here today…keep doing a fine job….
Oh btw, the gop does not know how to clearn on this mess that they left us to deal with in the first place…all they are doing is making noise with a lot of money and tv air in doing this…..Get out and vote for Gods sake….never assume….do something about if you are not good with the status quo….
Good to see you posting here Brenda! Last election here the sheriff race came down to a handful of votes at just one precinct. You can bet every vote counted that time! BTW, our candidate eventually won and stopped a family dynasty in law enforcement that would not have been pretty.

It is interesting to ask just what carrot the TParty actually offers SCOTUS. I doubt the promise of intelligent debate entered the scene. Was it intimidation? mmm hard to imagine.
That leaves power. But one has to ask Scalia, Thomas & Kennedy if the instant gratification of grabbing for a membership in the Koch Bros club outweighs the strength of justice America bestowed on the Court.
My travel days always involve a black thing behind me drooling down my neck and whinning to get out at the waterfall. I lost my Golden in June and black one is greatly distressed so we’re talking about looking at puppies in a few weeks…Pouch Cove line on west coast!

I’m looking at a newfie puppy and another Golden. My newfie “Satchmo” is now 10 and not as spry as he would like to be. He does however seem to be a master at snoring! Puppies are just so hard to go see, I always want to bring them ALL home!

Yeah, it’s a haul…We generally break up the trip from here (Rochester) to Acadia, stop at a half way point in Manchester, NH…get to hear things like drunk guy in TGIFriday’s yelling ‘Yankees suck’ in a town 45 miles from Fenway Pahk, thought he wouldn’t make it out alive…:-)
“Yankees suck” or “Red Sox suck”? Because anyone yelling hatred for the Yankees anywhere in New England is more likely to have someone offer to buy him a drink.
