Prompted in part by former FBI director James Comey’s testimony and in part by statements and tweets made by President Trump, both the House Intelligence Committee and the Senate Judiciary Committee sent out requests for any tapes or other records that the White House possesses that could clarify which one of them is the big fat liar. Requests were also made to James Comey, the FBI, and a law professor at Columbia University (who Comey used as a conduit to the media) to provide copies of Comey’s memos on his conversations with the president.
Now, it should be obvious that these requests would not be made if the truth doesn’t matter. If it turns out that there are tapes that prove the president did precisely what Comey says he did and the response is to do nothing about it, that will make everyone wonder why the truth was sought at all.
Personally, I doubt that tapes exist. If they do exist and they back up the president, I still don’t expect that we will all be listening to them soon. If they exist and the back up Comey, then those tapes will be destroyed rather than turned over.
There is one potentially complicating factor for Trump, and that has to do with the willingness of his White House counsel to engage in a coverup.
The leaders of the House Russia investigation, Reps. Michael Conaway, a Texas Republican, and Adam Schiff, a California Democrat, sent a request Friday directly to Comey for copies of his memos. They sent a separate request to Trump’s White House counsel, Don McGahn, for any record the White House had of their meetings.
Trump needs McGahn to put his neck on the line if there are incriminating tapes or other records and he doesn’t intend on producing them. Trump values loyalty highly and I don’t doubt that McGahn is highly loyal, but the prospect of federal prison time puts a lot of stress on even the tightest relationships.
If no tapes or other records exist or ever existed then Trump will have to admit that soon or find himself crosswise of multiple congressional committees, and probably Bob Mueller’s investigation as well.
If tapes and records do exist and he has no intention of producing them, then he will have to lie and “admit” that they don’t exist.
There’s one scenario that is unlikely but interesting to contemplate. Imagine if Trump has tapes that would prove Comey is a liar but can’t afford to admit that he’s been taping because it would open him up to having produce different conversations with different people that would be far more damaging. In other words, if he’s been taping he probably doesn’t want to admit that even if it would help him in this one case.
By far the least likely scenario is that the records exist that back Comey and that Trump will produce them. The only way that could happen is if someone like McGahn decides they’re not lying for Trump. Even then, though, I’d expect them to resign rather than sell Trump out.
I guess the most outlandish possibility is that Trump would arrange for records to be doctored in an effort to prove his innocence. He’d need a lot of help with that project, and I kind of doubt he could find it or that he’d get away with it if he was dumb enough to try.
Add this all up, and the odds are heavy that Trump will soon confess that he has no tapes and insist that he has no records, even if he does have them.
This will make him look stupid, and it’s risky if it’s a lie. But it’s still less perilous than admitting he’s been taping, especially if that compels him to produce records that prove his guilt.
And that word “guilt” is my main point here. People can make excuses for the president and say that he’s a political novice or that he didn’t intend to violate any laws. But the only reason to request these records is if it actually matters whether or not Comey is telling the truth. If Comey can be right and Trump can still be innocent, then what’s the point in trying to figure it all out?
Just that fact that Congress is demanding these records is an acknowledgment that Comey’s charges, if true, are very serious.
If Trump has been bluffing about the tapes, he can keep this at the level of two different versions of a story that no outsider can arbitrate. Most people will disbelieve him, and admitting his bluff will further hurt his credibility. But it’s a survivable position for him, especially with a Republican Congress.
But if there really are tapes, Trump is damned if he produces them and in big trouble if he doesn’t. If he produces them and they prove him right, he’ll still be vulnerable to new requests for tapes on other matters. Most likely, though, the tapes would take him down as quickly as they took down Nixon.
And if he doesn’t produce them, he’s going to have to manage a coverup that will require a willingness from some of his staff to take personal risks that may not be forthcoming. His White House is hardly known for its ability to keep secrets.
All of this, of course, is just on the narrow issue of the tapes. And the tapes may be the least of his problems.
Good analysis. Most likely there are no tapes, but there might have been conversations with others afterward about the content of the talks.
My early morning brain goes to two things. The silly doctor’s letter — which could be repeated in silliness again by someone about “tapes.” And, I’m struck that Trump, in his Comey firing letter, referenced three times Comey assured him he wasn’t under investigation (how Biblical). Then that was true. So I guess I can’t imagine Trump was really keeping track which means a bit of research went into that statement. Research from where? Who on team Trump made notes? Coming out of the January 6 one-on-one, who wrote things down for Trump to refer to later? Etc.

Why do you think he’s not dumb enough to try? Exactly what set of actions or tweets or spokespersons leads you to the conclusion that he’s in any way, shape or form smart?

I don’t need you to diagram my argument with symbolic logic, but please explain how you get from what I wrote that I think Trump is too smart to attempt to doctor evidence.
What I said is that I don’t think he’ll be able to find people willing to help him do it and that if he does find people who are willing to help him do it, they’ll do it in a way that gets them caught.
At no point did I say that he wouldn’t try it because he is too smart to do something so dumb.

I have read repeated posts here about how the GOP can’t get anything done, that they are incompetent and blah blah blah.
It now appears the may be close to overturning Obamacare.
This is a five alarm fire. Every left of center blog should be screaming.
I would not trade the impeachment of Trump for losing Obamacare.
The GOP may have learned one lesson from Obamacare: whatever you do do it fast, and minimize public input.

I’m sure he’s turned Trump’s imminent demise into a burning platform scenario for the Republicans. Trump’s the fastest lame duck in history and if we don’t have anything to run on in 2018 we’re all lame ducks with him when we get zero% turnout. Plus, in a 2018 wipeout there goes any chance to repeal Obamacare forever. So instead of Trump’s perfidy bring an obstacle to legislative progress, it now becomes an imperative to act.
So, in their classic party before country approach their best option with the hand they are holding is to support a bill with less than 10% public support because not doing so will prove disastrous for their base turnout next year.
Obamacare repealed, 2 or 3 Supreme Court appointments before Trump goes out early or in 2020 ain’t chopped liver for the base.
At this point Trump’s a sunk cost. The Republican senators have to focus on their 2018 message of accomplishments for the base.
If they are successful they will have achieved something 3 previous GOP Administrations could not achieve: evisceration of one of the crown jewels of the Great Society.
And after Trump signs the bill I predict we will still be reading about the GOP can’t govern.
By the same people who were certain Trump would never be elected in the first place.
Meanwhile he’ll press along with noncooperation just as long as he can.
I’ll stick with the Kevin Drum filter for Trump’s output: The only audience he addresses is his base, the rest of us aren’t worth considering. And while Trump is busily distracting the eyes, McConnell and Ryan are picking our pockets. Trump is toast, everyone, except Trump, knows it. But most folks still treat him as if what he is saying indicates what he’s doing. T’ain’t so. Trump is what test writers and pickpockets call a distractor.
Isn’t this just Obama’s birth certificate all over again?
Trump lied his ass off about having a sensational reveal on what his investigators found about Obama’s birth certificate, got called on it repeatedly, kept doubling down and yet still manged to parlay that notoriety into becoming president of the United States. Why would you expect him to do anything different with the Comey conversations? He will probably string this along until the cows come home and his idiot base will eat it up.
My prediction is that Trump will assert that the recordings exist, even though they don’t, and then claim executive privilege and refuse to release them.
That way he doesn’t have to admit to being a liar about having recordings, gets to claim that the recordings prove his position and exonerate him, and is never in danger of having that position refuted by the recordings because there aren’t any.
Congress can then dance around trying to force him to produce the recordings while he looks strong and resolute in refusing to do so. This can go on indefinitely until they actually impeach him.
I just hope Trump will testify under oath as he promised. That should speed things up. His lawyers will do their darnded best to stop him from that, but we can hope that he will show his independence from their advice.
Trump never did promise to testify under oath. Testify is never tied to ‘under oath’ specifically. He replied to a question about testifying with verbage that contained the phrases “one hundred percent” and “under oath” but did not connect the two.
And as we all know, Trump never goes back on a promise.
He could submit the tapes only for us to find out there is an 18-minute gap. Oh, my, how could that happen?!
